SM Reinsurance Company DMCC (“SM RE”) values you as a customer and we thank you for your confidence in choosing our company asreinsurer. As a client, you trust us with your personal information. We respect that trust and want you to be aware of our commitment to protect the information you share with us in the course of doing business with us.
How We Use and Disclose Your Information
When you purchase reinsurance from us, you share personal information so that we may provide you with the products and services that best meet your needs and provide the reinsurance protection you have requested. In order to do this, we may use and disclose your personal information for the purposes of, amongst other things, evaluating, monitoring and assessing reinsurance needs, providing risk management services, underwriting, rating, binding and issuing reinsurance slips and providing all policy related or administrative services, including verifying information, loss control, compliance with regulatory requirements, and claims investigation, surveillance, detecting and preventing fraud, adjustment and coverage assessment. This also includes collecting and disclosing personal information about third parties with respect to claims made. We may also disclose personal information to our affiliated companies for insurance or reinsurance purposes, and we may provide personal information for various claims services to our brokers, adjusters, repairs shops, contractors, construction companies, engineers, lawyers, accountants and others. To the extent required by law, we may also disclose personal information.
When we disclose data containing personal information to industry associations or service providers, the disclosure is subject to confidentiality requirements. All personal information collected by us is safeguarded with appropriate security measures. We will only retain personal information for as long as is necessary to fulfill the purposes for which it was collected or as is required by law. You have the right to access the personal information we hold about you, subject to the following (and any other reasonable or legal conditions which may be necessary), and, if the case may be, to request that the information be rectified if it is inaccurate, incomplete, ambiguous or collected in violation of the law. A request to that effect must be sent in writing to us. However, we are unable to provide access to such personal information in any of the following circumstances:
- if doing so would likely reveal personal information about a third party;
- if the information is subject to legal privilege;
- if revealing the information would reveal confidential commercial information;
- if revealing the information could affect the security of another person;
- if revealing the information could compromise the investigation of a claim;
- if the information relates to the actual or suspected breach of a reinsurance policy or,
- if the information was generated in the course of a formal dispute resolution process.
Type of Personal Information We Will Collect
We collect various types of personal information, depending on the particular purpose for collection and the circumstances involved. By way of example, and without limiting the scope of personal information collected, the type of personal information we may collect includes (but not restricted to) property description(s), claims history(ies), driving record(s), financial information and medical and health information.
How We Obtain Personal Information
Most of the personal information collected by us is provided by insurance companies, reinsurance companies, reinsurance brokers or adjusting firms (retained by us to investigate a claim or loss). Also, we obtain personal information from various third party sources as part of the underwriting process. For example, where we underwrite automobile insurance, we may obtain a record of driving offences and we may also obtain claims or underwriting information from other insurance companies or insurance industry sources. Our clients (including but not restricted to insurance companies, reinsurance companies, reinsurance brokers) are responsible for obtaining the consent of (re)insureds with respect to the collection of such information and we and/or our clients will infer such consent when appropriate.
We also collect personal information from a variety of sources in investigating, evaluating and adjusting claims. Personal information required for claims purposes may be obtained from our clients or from third party sources. We may collect such information directly or through insurance adjusters, private investigators or lawyers representing SM RE or our clients. Consent may be obtained by us or through clients, an insurance adjuster, investigator or lawyer when personal information is collected for claims purposes. Consent may not be obtained with respect to the collection of certain publicly available information. If information is collected with respect to an investigation involving the suspected breach of a reinsurance policy (or other agreement), or breach of applicable law, then consent may not be obtained. In some cases, we or our clients will infer such consent when appropriate.
When Your Consent Is Not Required
Knowledge and consent for the collection, use and disclosure of personal information are not required in many circumstances, such as:
- When SM RE discloses personal information to an approved investigative body;
- When SM RE believes that the information relates to the breach of a reinsurance policy or other agreement and it would compromise the availability of the personal information relating to that breach;
- When SM RE believes that the information relates to the contravention of any applicable law, including the detection and prevention of fraud;
- For compliance with summons to witness, search warrants or other judicial or governmental order(s);
- When legal, medical or security reasons may make it impossible or impractical to seek consent;
- When SM RE is under a public requirement to disclose personal information to appropriate authorities in matters of significant public interest;
- Where the individual in respect of whom the personal information relates, is a minor, seriously ill or mentally incapacitated and seeking consent is neither possible nor appropriate;
- Where the personal information is publicly available and is specified by the regulations; or
- When SM RE is required by law to disclose the information.
What We Will Not Do with Your Information
We do not sell customer information to anyone. Nor do we share customer information with organizations outside of our associated companies.
Cookies Policy
We can place cookies and other similar technology on your device, including mobile device, in accordance with your preferences set on our cookie consent manager. Why do we use cookies and similar technologies?
Cookies do a lot of different jobs, such as letting you navigate between pages efficiently, remembering your preferences and generally improving the user experience. Does SM RE use cookies for marketing and analytics?
Yes, we may use information collected from our cookies to identify user behavior and to serve content and offers based on your profile, and for the other purposes described below, to the extent legally permissible in certain jurisdictions.
In other cases, we can associate cookie information (including information from cookies placed via our advertisements on third party sites) with an identifiable individual. For example:
- If we send you a targeted email which includes web beacons, cookies or similar technologies we will know whether you open, read, or delete the message.
- When you click a link in a marketing e-mail you receive from SM RE, we will also use a cookie to log what pages you view and what content you download from our websites, even if you are not registered at or signed into our site.
Do you use any cookies from third party companies?
Some cookies, web beacons and other tracking and storage technologies that we use are from third party companies (third party cookies), such as Google Analytics to provide us with web analytics and intelligence about our sites which may also be used to provide measurement services and target ads. These companies use programming code to collect information about your interaction with our sites, such as the pages you visit, the links you click on and how long you are on our sites. This code is only active while you are on an SM RE website. Does SM RE use any tracking technologies similar to cookies?
We may also use web beacons (including conversion pixels) or other technologies for similar purposes as above and we may include these on our sites, in marketing e-mail messages or our newsletter, affiliated websites, to determine whether messages have been opened and links clicked on. Web beacons do not place information on your device, but they may work in conjunction with cookies to monitor website activity. The information provided below about cookies also applies to web beacons and similar technologies. Conversion pixels are small codes located on a particular web page which are triggered when someone visits a page resulting in an increase in the conversion count.
